Probate Matters
We deal Probate matters under our fixed fee arrangement or agree to charge a fee relating to the percentage of the estate from 1 to 5 percent of the value of the estate depending on the complications involved in the matter.
Our initial consultation fee for Probate Matters is £100 with our clients to discuss the circumstances of the deceased. In case of instructions the consultation fee is adjusted with our fee.
Principal solicitor Mr M Khaliq has over 10 years PQE deals the matters personally or directly supervise the case. However the cost of the matter depends on the circumstances like number of beneficiaries and the properties involved. For example if there is one beneficiary and no immoveable property involved then the cost will be lower whereas if there are more beneficiaries and multiple properties are involved then cost will be at the higher the range. We are not VAT registered at this stage and thus don’t charge VAT for our fee. If VAT is applicable to the disbursements then the clients are responsible for the payment of the applicable VAT relating to the disbursements.
The expected work relating to the Probate matters are between 8 to 16 hours though this could be discussed at consultation and vary depending on the complexity.
Our fixed fee relating to the straightforward small estate matters starts from £1800. Generally straightforward matters are considered where a valid Will can be identified, no immoveable property or intangible assets are involved in the estate. No dispute in beneficiaries and no inheritance tax payable and the executors are not required to file a full account to the HMRC.
We will handle the full process for you. Our fee quote is for estates where:
- There is a valid will
- There is no more than one property
- There are no more than 1 bank or building society accounts
- There are no other intangible assets
- There are 1/2 beneficiaries
- There are no disputes between beneficiaries on division of assets. If disputes arise this is likely to lead to an increase in costs
- There is no inheritance tax payable and the executors do not need to submit a full account to HMRC
- There are no claims made against the estate
Disbursements are not included in our fee and if VAT is applicable to the disbursements then you are liable to pay VAT included at 20
Disbursements of the Probate matters:
Disbursements are the expenses relating to your matter on top of our fees, these are payable to third parties such as court fees and/or accountant fees if required.
Probate Application fees for the estate over £5000 is £273
There is no application fee if the estate value is less than £5000
For each extra copies of the certificate is for £1.50
For complicated and contentious matters we charge fee on the basis of our hourly rate depending on the case worker.
Mr Masood Khaliq is the senior caseworker having over 10 years PQE and his hourly rate is £385. We are not VAT registered so VAT is not applicable to our fees.
Hourly Charges:
We charge hourly basis for the Judicial Review (JR) matters and permission to appeal to Court of Appeal and/or the appeal matters in the Court of appeal. Our hourly fees will be calculated using below hourly rates and also will depend on the level of experience of the solicitor or fee earner dealing with your matter and complexity of the matter. Mr Masood Khaliq is the Principal Solicitor of the firm who has over 10 year post qualified experience (PQE). All the matters are dealt by a fully qualified solicitor or under his/her direct supervision. Details of the hourly rates are as under:
Hourly Rate of Principal Solicitor: £385
Hourly Rate of Associate Solicitor: £250
Hourly Rate of Paralegal Staff: £160
However, we are happy to discuss our fee estimates and hourly rates with you to give a closer estimate of the likely costs bearing in mind the level and complexity of your case.
The exact number of hours it will take depends on the circumstances in your case such as:
- The complexity of your matter
- The amount of supporting evidence that we need to consider
- The language(s) you speak
- Whether you are applying with other dependants
If you are able to provide sufficient and concise evidence at our first meeting and clearly meet the applicable Immigration Rules, the legal costs are likely to be at the lower end of the costs estimate.
We will of course be happy to provide you with an estimate of fees and disbursements on the above work on request.

Once we have taken your instructions, received your full supporting documents and fees, we will be able to submit your application to the Home Office as quickly as possible. The time it takes will be subject to how quickly all relevant information and documentation takes to collate.
